LAW: Baby Accused of Crying Like a Baby Claims Baby Defence: I am A Baby! Also claims Nappy Defence.
A baby boy in Prospect, South Australia accused of purposely disrupting the peace of shoppers at an Adelaide Bunnings Store has successfully raised the Doli Incapax defence in Court where no child under 10 is capable of forming a guilty mind
The alleged offence took place at the Bunnings Store on the corner of Churchill Rd &, Regency Rd, Prospect SA 5082 in early January 2022. Some shoppers were so stressed that Bunnings called police and asked that the baby be arrested for disturbing the shopping peace.
 
At trial the learned judge was enlightened through the baby's personal representative that the baby was merely objecting to the lack of trees in the baking concrete car park surrounding the Bunnings store. "I was hot, and needed a new nappy." said the baby. "There were no trees. None at all. Nowhere natural or shady for my Mum to change my nappy. I like ducks."
The baby also informed the court, through the baby's personal representative, that its behaviour was not a result of the Bunnings' chain offer to beat prices on any identical item by more than 10%, thereby rebutting the not disproved presumption raised by the lawyers for Bunnings that the baby had actually found an identical item at a nearby store and was trying to claim the refund when felled by a dirty nappy.
"It's no fun being a baby with a dirty nappy in a hot treeless carpark" said the baby.
The judge agreed and dismissed the case with costs awarded against Bunnings, with the costs document typed up in big green stencil letters.
